Debt and Fraud

Course Overview

Clients can be either the perpetrator of (benefit overpayments/credit applications) or the victim of (ID theft) fraud or a scam. The Course considers the differences (in law) between the Fraud and the Theft Act and how fraud impacts on advice work in terms of:

       
  • A benefit overpayment fraud investigation and prosecution of the client
  •    
  • Identity fraud and the client is being pursued for a debt they do not owe
  •    
  • A client having been “scammed;”  money has been taken from a bank account or a credit card for goods or purchases
Learning Objectives

 

By the end of this course, delegates will:
  • Outline the difference between an allegation of a fraudulent application and a proven fraud benefit claim
  • Describe the process benefit providers take in investigating fraud – from allegation of, to prosecution in Magistrates Court
  • Identify what action to take in arguing and evidencing a case in which the alleged debt is a result of ID theft
  • Explain how a client who has been scammed may seek a refund from a bank/credit card provider – and what to do if the provider refuses
  • Assess what the limits of our intervention are and what practical steps we can take as advisers
